MOBILE MESSAGING TERMS AND CONDITIONS

Subject to your consent, Thinkspan may use various mobile messaging services (including various services which rely on automated telephone dialing system functions) to communicate with you, including without limitation: Short Message Service (SMS), Multimedia Message Services (MMS), and business chat features (collectively referred to as our “Messaging Services”). 

The following Mobile Messaging Terms and Conditions (“Messaging Terms”) govern your use or participation in any of our Messaging Service features, as described below.

  1. Informational Messages: When you register for our services you may be asked or required to provide a valid mobile telephone number (“Mobile Number”) in conjunction with other registration information. When you provide a Mobile Number for registration purposes, you expressly authorize us to send, and you consent to receive, calls and/or messages which we send to your Mobile Number from our Messaging Services for registration confirmation and for other informational purposes; and further, you agree that your authorization and consent will be effective even if you are on a state or the federal Do Not Call registry when you register. 
  2. We Can Respond if You Contact Us: If you contact us and/or request information from us via any Messaging Service, you agree that you have provided us with the necessary authorization and consent to call or text you (at your “Mobile Number”) in response; and again, you agree that your authorization and consent will be effective even if you are on a Do Not Call registry when you contact us. Also, we may send you a customized contact card, which can facilitate communications between us, and which you have the option of downloading to your device.
  3. Commercial Messages: If you expressly consent in any reasonable way (such as by responding ‘yes’ to an informational message which provides you with the ability to opt in) to receive commercial communications from us via Messaging Services, then (a) you expressly authorize us to send, and you consent to receive, commercial messages from us which we send to your Mobile Number via our Messaging Services; and (b) you agree that your authorization and consent will be effective even if you are on a state or the federal Do Not Call registry when you opt in.
    a. Consent
    : We may ask for your consent to send commercial and/or promotional messages in any of the following ways: email, SMS, MMS, business chat, or via a ZK (Zero Knowledge) communication delivered via our applications.  
    b. Opt Out
    :  If you receive a message from us (sent via a Messaging Service) that contains promotional information, you can opt-out of receiving future messages by replying “STOP” or as otherwise directed in the message. We strive to process opt out requests which are submitted in any reasonable manner (e.g., using terms like “cancel,” “unsubscribe,” etc.).  If you have any concerns, or need additional assistance, please feel free to contact us as set forth in Section 13, below.  
  4. Policies: Our Messaging Services are subject to the terms of Thinkspan’s Privacy Policy and Terms of Service. 
  5. Messaging Costs:  Messaging Services are provided as a free feature of our services; however, message and data rates may apply from your wireless service provider, and you are responsible for all applicable costs and taxes. 
  6. No Other Automatic Opt Ins:  When you opt-in to Messaging Service features your consent will not be used to automatically opt you in to any additional kinds of services available on our Sites (e.g., paid subscription services), unless we have your consent to do so. 
  7. Message Frequency:  The frequency of various kinds of messages will vary according to the kind of message, the service(s) to which you are subscribed, and the consent(s) you provide.  
  8. You may unsubscribe from SMS/text messages at any time by following the directives in our Privacy Policy. After opting out, you may resubscribe at any time by following the subscription directives. 
  9. For technological reasons, all messages sent to or from our Sites may be recorded and retained. By accessing or using any of our Messaging Services you consent to the recording of your messages, and you agree that you will have no (and hereby waive all) claims for illegal wiretapping or the like with regard to such recording. Any messages you send to us become our property. 
  10. We may change any short code or telephone number we use to operate the Services at any time and will notify you of these changes, if necessary. You acknowledge that any messages, including any STOP or HELP requests, which you send to a short code or telephone number that we have changed may not be received - and accordingly, we will not be responsible for honoring requests made in such messages. 
  11. If you provide us with a Mobile Number for use with the services, and you thereafter acquire a new Mobile Number, you agree to notify us and update your account, as applicable, to reflect any changes. 
  12. In general, mobile messaging is not a secure mode of communication, so personal information of a sensitive nature should not be provided via mobile messaging.
